Exercise of stopping up powers

R (on the application of Spice) v Leeds City Council, 27 February 2006 (Administrative Court).

The High Court has ruled on the questions which should have been addressed when a highway authority was considering an application to the magistrates court to stop up a highway. The same issues were relevant when a highway authority received a request from a third party to make such an application. The highway authority was required to take into account all those factors which the magistrates would themselves consider when determining whether to make a stopping up order.
