Non-party disclosure

This practice note summarises the main methods for a party to obtain documents from a non-party to the proceedings. The court may:

  • Order non-party disclosure under CPR 31.17.
  • Issue a witness summons under CPR 34.2, requiring a witness to produce documents to the court.
