Section 21 Limitation Act 1980 applies only to true trustees (Supreme Court)

In Williams v Central Bank of Nigeria [2014] UKSC 10, a majority of the Supreme Court allowed an appeal by the bank, finding that the claim against it was time-barred. The judgment considers the scope of section 21(1) of the Limitation Act 1980 in relation to claims by a beneficiary of a constructive trust, and the distinction between claims based on knowing receipt and dishonest assistance in breach of trust.
