Parties' conduct relevant to whether to enforce cross-undertaking in damages (High Court)
In Fiona Trust and Holding Corporationg and others v Privalov and others [2014] EWHC 3102 (Comm), the Commercial Court considered whether to order an inquiry as to damages payable under undertakings in damages given by the claimants in relation to freezing orders. In particular, it considered whether the claimants had made misrepresentations and non-disclosure when applying for the injunctions, and misconduct by the defendants.
