The meaning of "construction operations" under Construction Act 1996 (TCC)
In Fahstone Ltd v Biesse Group UK Ltd [2015] EWHC 3650 (TCC), Edwards-Stuart J declined to order summary judgment to enforce an adjudicator's decision, on the basis that there was at least a triable issue that the supply and installation of a large woodworking machine was not a construction operation because the machine did not form part of the land.
