Contiguous extensions of time and extinguishing liability for liquidated damages (TCC)

In Carillion Construction Ltd v Woods Bagot Europe Ltd and others [2016] EWHC 905 (TCC), Miss Recorder Nerys Jefford QC (sitting as a judge of the Technology and Construction Court), considered whether an extension of time should run contiguously from the existing date for completion and whether the contractor's agreement with the employer concerning its liability for liquidated damages under a building contract extinguished its liability, thereby preventing a claim against its sub-contractors.
The Court of Appeal has dismissed an appeal against the TCC's finding that the sub-contractor's extension of time should have been contiguous, see Legal update, Contiguous extension of time in sub-contract (Court of Appeal).
