Advocate General opinion that e-books are covered by Rental and Lending Directive

by Practical Law IP&IT
Advocate General Szpunar has given an opinion that the lending right in Article 1 of the Rental and Lending Directive (2006/115/EC) includes the making available to the public of electronic books by libraries for a limited period of time. (Vereniging Openbare Bibliotheken v Stichting Leenrecht, Case C-174/15, 16 June 2016.)
NOTE: On 10 November 2016, the ECJ handed down its decision in this case (see Legal update, ECJ rules that e-books covered by Rental and Lending Directive). (See details of Practical Law IP&IT and Media & Telecoms policy on annotating case reports.)
