On 4 July, 2002, the Code Committee issued Response Statement 9 (RS 9) and Response Statement 10 (RS 10), its responses in relation to Public Consultation Papers 9 and 10, approving with immediate effect amendments to the City Code on Takeovers and Mergers (the Code) in relation to questions as to the potential concertedness of the trustees of an employee benefit trust with the board and/or a controlling shareholder and the corresponding addition of a new Note 5 to Rule 9.1 of the Code and in relation to shareholder activism and acting in concert and the corresponding amendments to Note 2 to Rule 9.1 of the Code.
