ECJ ruling on the award of a public service contract to an undertaking with partly private capital

On 11 January 2005, the European Court of Justice (ECJ) handed down its ruling, confirming that the award of a public service contract by a contracting authority to an undertaking in whose capital it has a holding together with one or more private undertakings, regardless of the percentage of that holding, is not exempt from the EC public procurement rules.
