Unless orders: an example of the court's approach

Marine Rescue Technologies Ltd and ors v Michael Burchill and ors [2007] EWHC 1976 (Ch) is illustrative of the court's approach to an application for relief from sanctions under CPR 3.9. The case is an example of where the court may refuse relief even though the failure to comply with an unless order was "probably" the fault of the party's advisers.
