EIA: how long is a screening direction valid? (High Court)

The High Court held in R (Mageean) v Secretary of State for Communities and Local Government [2010] EWHC 2652 that the passage of time alone did not give rise to the requirement for a screening direction to be referred back to the Secretary of State for reconsideration.

Note added (17.08.11): The Court of Appeal has allowed an appeal against this decision. See Legal update, EIA: how long is a screening direction valid? (Court of Appeal).
