By using the adjudication case study, practitioners can follow a construction dispute comprising a sub-contractor's claim for loss and expense and an extension of time from the notice of adjudication through to enforcement proceedings.

The scenario:
  • Was written by Lynne McCafferty, barrister at 4 Pump Court, and has been reviewed and updated to take account of the amendments to the Housing Grants, Construction and Regeneration Act 1996 (Construction Act 1996).
  • Provides a complete set of example materials and is now based on our set of adjudication standard documents, which were written by Melissa Moriaty at Berwin Leighton Paisner LLP.
  • Starts off in 2012 when work began on site. It proceeds through a dispute over the sub-contractor's claim for loss and expense and an extension of time, which it referred to adjudication (including an unsuccessful challenge to the adjudicator's jurisdiction) and concludes with enforcement proceedings in the Technology and Construction Court (TCC) in October 2013.
