Mitchell guidelines not applicable to "in-time" applications for time extensions (Companies Court)

In Kaneria v Kaneria and others [2014] EWHC 1165 (Ch), in the context of an unfair prejudice petition (under section 994 of the Companies Act 2006), the court considered an opposed application by several of the respondents for an extension of time for service of their defences, and a cross-application by the petitioner seeking an order that the respondents be debarred from defending the petition.
