Local authority in which individual lived before being made subject to a hospital order under the Mental Health Act 1983 remains responsible for their aftercare (Court of Appeal)

In R (Wiltshire Council) v Hertfordshire County Council [2014] EWCA Civ 712, the Court of Appeal held that Wiltshire Council, and not Hertfordshire County Council, was the responsible authority under section 117(3) of the Mental Health Act 1983 for the aftercare of an individual who was hospitalised in the Hertfordshire area.
