Right to adjudicate not granted by Third Party Rights Act 1999

In Hurley Palmer Flatt Ltd v Barclays Bank plc [2014] EWHC 3042 (TCC), Ramsey J granted the declaratory relief sought and held that the Contracts (Rights of Third Parties) Act 1999 (Third Party Rights Act 1999) did not grant a third party the right to adjudicate a dispute arising under the construction contract (in this case, a professional appointment). This meant the notice of adjudication was ineffective and the adjudicator did not have jurisdiction.
