Private hearings and scope of implied waiver of legal professional privilege (High Court)

In Eurasian Natural Resources Corporation Ltd v Dechert LLP [2014] EWHC 3389 (Ch), the court considered whether it should exercise its discretion under CPR 39.2 to order that an application for taxation of a bill of costs be heard in private and the circumstances and scope of an implied waiver of legal professional privilege.
NOTE: On 19 April 2016, the Court of Appeal unanimously dismissed an appeal against this decision (see Dechert LLP v Eurasian Natural Resources Corporation Ltd [2016] EWCA Civ 375, considered in Legal update, Solicitor-own client costs assessment can be held in private (Court of Appeal).
