In ParkingEye Ltd v Beavis [2015] EWCA Civ 402, the Court of Appeal considered whether a charge imposed for overstaying the free period of parking in a car park was unenforceable at common law, as a penalty, or whether it was unfair and, therefore, unenforceable under the Unfair Terms in Consumer Contracts Regulations 1999.
