Upper Tribunal rules FOIA request decision failed to consider witnesses to whom data protection principles applied

The Upper Tribunal (Administrative Appeals Chamber) has set aside a First-tier Tribunal decision that the Nursing and Midwifery Council had been obliged to confirm or deny whether it held the names of witnesses interviewed at an investigating committee hearing. (Information Commissioner v CF and another [2015] UKUT 449 (AAC), 10 August 2015.)
