Post Etridge undue influence

UCB Corporate Services Ltd v Williams, 2 May, 2002 (Court of Appeal).

Many claims to have charges set aside because of undue influence were put on hold pending the House of Lord's decision in Etridge. This case illustrates some of the difficulties faced by a lender following that decision where prior to Etridge, the court favoured the lender's position but after Etridge, the court supported the claimant's appeal.
