Flee clauses

by Kathryn Purkis, Serle Court
A flee clause is a clause in a trust document which purports, on the occurrence of specified "trigger" events, automatically to transfer the trusteeship and administration, the trust assets, and probably also the governing law of the trust to another jurisdiction or other jurisdictions. This note considers some issues relating to the drafting and enforcing of flee clauses. It also highlights some alternatives to flee clauses.
