Flee clauses

A flee clause is a clause in a trust document which purports, on the occurrence of specified "trigger" events, automatically to transfer the trust assets, administration and governing law of the trust to another jurisdiction. This note considers some issues relating to the drafting and enforcing of flee clauses. It also highlights some alternatives to flee clauses.
