Significance of limitation defence when extension of time to serve claim form sought (Court of Appeal)

In Bayat Telephone Systems International Inc and others v Lord Michael Cecil and others [2011] EWCA Civ 135, the Court of Appeal allowed an appeal and set aside two orders extending the time for service of a claim form after the expiry of the limitation period and also held (obiter) there was no good reason for an order granting permission to serve by alternative means.
Note that, on 12 July 2011 the Supreme Court refused permission to appeal in this case.
