Ante-nuptial settlement

A form of trust that is made in contemplation of marriage and benefits one or both parties to a marriage. The court can vary an ante-nuptial settlement in some circumstances to make financial provision for the parties to the marriage or their children (section 24(1)(c), Matrimonial Causes Act 1973). Whether a trust is a nuptial settlement is often complicated and technical and requires specialist advice.
