Upper Tribunal considers which aspects of section 35 of FOIA should be given an "inherent weight"

On 20 October 2014, in Cabinet Office v Information Commissioner [2014] UKUT 461 (AAC), the Upper Tribunal (Administrative Appeals Chamber) considered the inherent weight carried by the exemptions in section 35(1) of the Freedom of Information Act 2000 and whether the fact that an exemption was engaged at all was sufficient to place some weight in the public interest balance against disclosure.
