In Ministry of Justice v Burton and another [2016] EWCA Civ 714, the Court of Appeal considered whether, in the context of a less favourable treatment claim brought by part-time property judges in respect of fees paid for decision writing, the employment tribunal had acted properly when fixing the daily rate. It also considered the employment judge's refusal to review his decision under the reconsideration procedure.
