New EC Merger Regulation: Entry into force

In January 2004 the EU Council of Ministers formally adopted a new EC Merger Regulation which will come into force on 1 May 2004. The new Regulation introduces a new 'dominance test' under which concentrations will be found to be incompatible with the common market where they would significantly impede effective competition in the common market, or in a substantial part of it, in particular as a result of the creation or strengthening of a dominant position.
