This note deals with legal issues arising out of surveillance of employees' use of email and the internet, including under the Data Protection Act 1998 and the associated ICO Employment Practices Code, the Human Rights Act 1998, the Regulation of Investigatory Powers Act 2000 and the Telecommunications (Lawful Business Practice) (Interception of Communications) Regulations 2000 (SI 2000/2699). The note also gives practical guidance on implementing monitoring systems and policies.
