Judicial review challenge to Barnet Council's outsourcing decisions fails (High Court)

In Nash v Barnet London Borough Council [2013] EWHC 1067 (Admin), the High Court held that the claimant's judicial review challenge to the council's decisions to outsource a large number of its functions and services was out of time as it was not made within three months from the date when the grounds for the application first arose. Although the claimant was challenging the council's decisions to award the contracts to private sector organisations, the substance of her challenge was to the council's earlier decisions in 2010 and 2011 to proceed with the procurement process for the outsourcing of its functions and services.
Note: on 2 August 2013, the Court of Appeal upheld a decision by the High Court refusing N permission to apply for judicial review on the grounds that the challenge had been brought out of time.
