In Lindum Group Ltd v Fernie and another [2014] EWCA Civ 124, Lewison LJ dealt with an application for permission to appeal and referred to the "very unusual" case of Whyte and Mackay Ltd v Blyth & Blyth Consulting Engineers Ltd [2013] CSOH 54. Whyte and Mackay referred to Article 1 of the First Protocol of the European Convention on Human Rights (ECHR) in the context of adjudication enforcement.
