Information from Charity Commission inquiry exempt from disclosure under FOIA but not necessarily under common law (Supreme Court)

On 26 March 2014, the Supreme Court handed down its judgment in Kennedy v Charity Commission [2014] UKSC 20. The court held that section 32 of the Freedom of Information Act 2000 contained an absolute exemption in respect of documents used by the Charity Commission in its inquiries. However, the exemption did not infringe the appellant's rights under Article 10 of the European Convention on Human Rights as there existed other legal routes to access the information.
