Absolute and skill and care obligations existed side by side

In MT Højgaard a/s v E.ON Climate and Renewables UK Robin Rigg East Ltd and others [2014] EWHC 1088 (TCC), Edwards-Stuart J determined the parties' dispute in connection with the design and construction of offshore wind farm foundations, finding that the contractor was in breach of an obligation to deliver works with a minimum service life of 20 years.
Note added 3 August 2017: This judgment was overturned by the Court of Appeal (see Legal update, Liability when international standard is incorrect (Court of Appeal)), which, in turn, has been overturned by the Supreme Court (see Legal update, Liability when international standard is incorrect (Supreme Court)).
