ECJ ruling on right to exclude bid for failure to include statement relating to technical director

On 6 November 2014, the ECJ handed down its ruling on a preliminary reference from an Italian court on whether EU law precludes the exclusion of an economic operator from a procurement procedure on the ground that the operator has failed to comply with a requirement to include a statement that its designated technical director has not been the subject of criminal proceedings or a conviction.
