State immunity law set aside to give effect to Fundamental Charter right (Court of Appeal)

In Benkharbouche and another v Embassy of the Republic of Sudan [2015] EWCA Civ 33, the Court of Appeal considered whether European law required provisions of the State Immunity Act 1978 to be set aside to allow individuals employed in the UK by foreign diplomatic missions to assert various employment rights.
