Citizenship not a reason for adult adoption (High Court)

FAS v Bradford Metropolitan District Council [2015] EWHC 622 (Fam) concerned an adoption application for an 18 year old male from Pakistan. Mostyn J reviewed the case law in similar cases and concluded that Re B (A minor) (Adoption order: nationality) [1999] 2 AC 136 with a modification remains the test to be applied. He concluded that where the only benefit to an adoption is citizenship, the court should rarely make an adoption order, as the court would trespass on the Home Secretary's immigration powers.
