In Iliffe and another v Feltham Construction Ltd and others [2015] EWCA Civ 715, the Court of Appeal overturned the first instance judgment of Stuart-Smith J, who found in favour of an employer under a building contract and granted summary judgment on liability following the near total destruction of a substantial private house.
