Extradition from the UK: provisions that apply to Part 1 and Part 2 requests

This note explains the process of extradition as it applies to Part 1 and Part 2 under the Extradition Act 2003. Extradition requests made in support of a pending or ongoing prosecution in the requesting territory, for the purpose of prosecuting the defendant, are referred to in these notes as "accusation cases". Extradition requests made in support of concluded criminal proceedings following the conviction of a defendant in the requesting territory, for the purpose of sentencing or service of a sentence already imposed, are referred to in these notes as "conviction cases".
