Practical Law UK Practice Note 4-200-2161 (Approx. 35 pages)

Data subject access requests in employment (DPA 1998 version)

Data subject access requests are often used as a tool in disputes between employers and employees. This practice note considers the nature of an employee's rights, and an employer's obligations to provide information, under section 7 of the Data Protection Act 1998.
Note: On 25 May 2018, the EU General Data Protection Regulation (GDPR) took effect and the Data Protection Act 1998 was in large part repealed and replaced by the Data Protection Act 2018. For information on data subject access requests under the new regime, see Practice note, Data subject access requests in employment (GDPR).
