Due diligence on a construction document

A checklist for carrying out due diligence on a construction document or a suite of construction documents such as a building contract, a suite of professional appointments or a suite of collateral warranties or third party rights.
The checklist helps to identify matters that could be highlighted in a report on the construction aspects of a proposed sale, lease or financing transaction, or which will form part of a report on title.
Note: The Building Safety Act 2022 (BSA 2022) imposes a range of obligations and liabilities on parties involved in a construction project. For every higher-risk building, this includes introducing a "golden thread" of information and creating a "gateway" regime under the Building Act 1984. For all buildings, there are additional dutyholder obligations (with more onerous obligations in relation to higher-risk building work).
