In Carillion Construction Ltd v Stephen Andrew Smith [2011] EWHC 2910 (TCC), Akenhead J in the Technology and Construction Court (TCC) has issued a CPR Part 8 declaration that the referring party referred the same or substantially the same dispute to adjudication again, so the third adjudicator lacked jurisdiction.
