Specific disclosure: application notice (with drafting notes)

An example of an application notice seeking an order for specific disclosure under CPR 31.12. Click here to view it.
This model application notice should be read in conjunction with the associated drafting notes, which are set out below.
This model application notice is based on court form N244: Application notice. Click here to view a blank copy of the form.
Disclosure in the B&PCs: CPR 31.12 does not apply to cases subject to PD 57AD ("Disclosure in the Business and Property Courts"). Alternative procedures are available; in particular, under PD 57AD.17 (Failure adequately to comply with an order for Extended Disclosure) and PD 57AD.18 (Varying an order for Extended Disclosure; making an additional order for disclosure of specific documents). For details of our comprehensive materials on the approach to disclosure under PD 57AD (and its predecessor, PD 51U), see Disclosure in the B&PCs toolkit. See, in particular, Practice note, Disclosure in the B&PCs: applications under PD 57AD.17 (failure (or possible failure) adequately to comply with an order for Extended Disclosure)
Remember that PD 23A.2.1 requires the N244 to be signed, regardless of whether or not a statement of truth is required.
