Ameliorating waste

An improvement to an estate that changes the physical character of the property. It is one of the four types of the tort of waste ( www.practicallaw.com/6-525-3517) , and is to be distinguished from the concept of waste under environmental law.

A claimant is likely to be unsuccessful in its claim for damages when the property has been improved. The court will only award an injunction if it sees fit.
