Preparing a disclosure report

This practice note sets out practical points for consideration when preparing a disclosure report under Civil Procedure Rule (CPR) 31.5(3).

Disclosure in the B&PCs: There is no requirement for a disclosure report in cases subject to PD 57AD ("Disclosure in the Business and Property Courts"). PD 57AD took effect on 1 October 2022, replacing what was PD 51U, and implementing procedures that operated (from 1 January 2019 until 1 October 2022) under the Disclosure Pilot Scheme (PD 51U) on a permanent basis. Under PD 57AD, parties are required to complete a Disclosure Review Document (which replaces the disclosure report and optional Electronic Documents Questionnaire).
