In Joint Stock Company ‘Aeroflot Russian Airlines’ v Berezovsky and others [2013] EWCA Civ 784, the Court of Appeal considered whether the claimant had consented to a Swiss jurisdiction clause, and whether a Swiss arbitration agreement could be impugned under Swiss law because it would lead to a multiplicity of proceedings.
