High Court correct to order possession for anti-social behaviour in reliance on hearsay evidence (Court of Appeal)

by Practical Law Public Sector
The Court of Appeal has dismissed an appeal against a High Court decision granting possession to a social housing landlord for arrears of rent and anti-social behaviour. The Court of Appeal confirmed that proper weight had been given to the hearsay evidence which supported the finding of anti-social behaviour. (John Boyd v Incommunities Limited [2013] EWCA Civ 756 (26 June 2013).)
The judgment has only recently become available.
