In Co-Operative Group Ltd v Birse Developments Ltd and others [2014] EWHC 530 (TCC) Stuart-Smith J in the Technology and Construction Court (TCC) held that a building contractor's cause of action in tort against its sub-contractors accrued on or before practical completion and that a failed assignment did not create a trust for the benefit of the putative assignee.
