In Khaled v SSHD (No. 1) [2016] EWHC 857 (Admin), the High Court considered the admissibility of expert evidence in judicial review proceedings challenging the lawfulness of returning the claimants to Bulgaria. In particular, the court considered whether the provisions of CPR 35 applied in such proceedings.
