Non-party costs order against principal beneficiary of defence (High Court)

In The Creative Foundation v Dreamland Leisure Ltd and others [2016] EWHC 859 (Ch), the High Court considered an application for a non-party costs order under section 51(3) of the Senior Courts Act 1981. The claimant contended, amongst other things, that the proceedings were defended principally for the benefit of the non-party and that she was actively and closely involved in decision-making regarding the defence.
