9th BIICL Investment Treaty Forum Public Conference: The Emerging Jurisprudence of International Investment Law

The Investment Treaty Forum at the British Institute of International and Comparative LAW (BIICL) held its 9th biannual conference on the subject of "The Emerging Jurisprudence of International Investment Law" on 14 September 2007.

The event was well attended by practitioners, arbitrators, academics and representatives from industry and the public sector in various jurisdictions. The programme comprised three sessions which covered the following topics:

  • Precedent and control in investment treaty arbitration
  • Fragmentation and custom in investment treaty law
  • Analysis of developing jurisprudence in international investment law
Year-in-review
  • Fair and equitable treatment
  • Nationality
  • Most-favoured nation treatment
  • Umbrella clauses
A forum panel discussion

Jan Paulsson also gave a keynote address on the topic of "Awards and awards", in which he considered the "varying degrees of persuasiveness" of awards and the factors which lay behind this, such as the standing of the tribunal, whether there is a sole arbitrator or three man tribunal and the effect of dissenting opinions and annulment proceedings.
