Proportionality defence to an eviction in Council's possession proceedings fails (County Court)

In Brighton and Hove City Council v Alleyn and others [2011] EW Misc 6(CC) (5 April 2011), the county court held that the council was entitled to a forthwith possession order since evicting defendant travellers was a proportionate response under Article 8 of the European Convention on Human Rights.
