Care costs capital disregards: local authority applied wrong test to daughter's occupation of home (High Court)

The High Court quashed a local authority's decision not to disregard the value of an individual's home when assessing whether she should pay for care home fees. The decision focused on the occupation of the home by the individual's daughter and whether this triggered the automatic disregard in paragraph 2(1) of Schedule 4 to the National Assistance (Assessment of Resources) Regulations 1992. (R (Walford) v Worcestershire County Council [2014] EWHC 234 (Admin)).
